These Terms of Service (“Terms”) govern your use of the APEX Project website and our matching service (“APEX,” “we,” “us,” or “our”). By using our site or submitting your information through our forms or matching tools, you agree to these Terms. If you do not agree, please do not use the service.
What APEX is (and is not)
APEX is an independent contractor-matching and referral service for Florida property owners. We connect you with vetted, licensed contractors and help you explore financing options for home upgrades, primarily through PACE programs that can offer $0 down.
We are not a contractor, a lender, or a PACE program administrator. We do not perform construction work and we do not provide financing ourselves. Our role is limited to matching you with independent third parties who do.
Third-party contractors and financing providers
Any contractor we match you with, and any PACE program, lender, or other financing provider you are referred to, is an independent third party. They are not employees, agents, or partners of APEX, and we do not control their work, their pricing, their schedules, or their decisions.
Your relationship for the actual work and the actual financing is between you and that third party, under their own contract and terms. We encourage you to review those agreements carefully and to confirm a contractor's license, insurance, and references before signing anything.
Estimates are illustrative only
Any prices, payment amounts, savings figures, or estimates shown on this site — including those produced by our calculators and matching tools — are illustrative examples only. They are provided to help you understand how an upgrade might work, and they are not an offer, a quote, or a guarantee of approval, pricing, or terms.
Your actual cost and payment terms depend on factors such as your property, the scope of work, and the financing provider's assessment. Only a written estimate from the contractor and a written offer from the financing provider reflect real, binding numbers.
Eligibility and financing terms
Eligibility for any financing program, including PACE, and the final terms of that financing are determined solely by the financing provider, not by APEX. Approval is never guaranteed. PACE financing is typically repaid as a non-ad-valorem assessment on your property tax bill, and program availability and rules vary by county and provider.
You are responsible for reviewing and understanding the terms offered to you before you agree to them. APEX does not make any decision about your eligibility and does not set the rates, fees, or repayment terms of any financing.
No warranty
The site and our matching service are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant the work, conduct, pricing, or results of any contractor, lender, or financing provider, and we make no warranty that you will be matched, approved, or satisfied with any third party. Any warranty on the actual construction work is provided by the contractor or manufacturer, not by APEX.
Limitation of liability
To the fullest extent permitted by law, APEX and its owners, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising out of your use of the site or out of the work, services, or financing provided by any third party we match you with.
Because we do not perform the work or provide the financing, any dispute about the work or the financing is between you and the relevant third party. Nothing in these Terms limits any liability that cannot be limited under applicable law.
Your responsibilities
You agree to provide accurate information, to use the site only for lawful purposes, and to make your own independent decisions about any contractor and any financing. You are responsible for your own due diligence before entering into any agreement with a third party.
Governing law
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. You agree that any dispute relating to these Terms or your use of the site will be handled in Florida, to the extent permitted by applicable law.
Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of our site after a change means you accept the updated Terms.
